Public offer about obtaining a loyalty card

1. General provisions

1.1. With this public offer, «Kamoil» Limited Liability Company, TIN - 03523673, legal address - RA, Yerevan, st. Erebuni 12/4, director - Kamo Melkonyan, hereinafter referred to as the Company, invites individuals to sign an agreement to participate in the Loyalty Program (hereinafter referred to as the Program) in accordance with the procedure and terms provided for in this public offer (hereinafter referred to as the Agreement).

1.2. This Agreement is a public offer, and if it is accepted by an individual, the latter becomes a Loyalty Program Participant (acceptance of the offer is equivalent to concluding a contract in accordance with the procedure and terms specified in the offer).

1.3. The completion and confirmation of the Personal Account data by the Customer and the acquisition of the loyalty card (hereinafter referred to as the Card) as property constitutes his/her full and unconditional consent to accept the Agreement.

1.4. The Agreement may be changed by the Company at any time. Participants will be notified of any amendments to the Agreement on the Company’s Website/Application in the manner specified in this Agreement.

1.5. The Card is intended for personal use by the Participant and cannot be transferred/sold to third parties.

1.6. The individual has the right to refuse this Offer.

2. Terms and definitions

2.1. Gas Station (hereinafter referred to as the Gas Station) - a technological complex equipped with equipment for the storage and retail sale of petroleum products/intended for the storage and retail sale of fuel, where the Participant has the right to receive fuel in accordance with the established procedure.

2.2. Application: a form that the Participant must fill out in the Company's mobile application or in the Station to activate the Card. The completed application form, along with the acquisition of the Card, is an expression of the Participant's consent to participate in the Program.

2.3. Point: a unit of account used within the Program, which allows the Participant to accumulate bonus points when purchasing fuel or other products from the Station.

2.4. Card: a plastic or virtual card that has a registered unique number, which is used as an identifier. The identifier on the card is used to log in to the account, which contains information about the status of the accumulated balance within the framework of the Program, according to which the Participant has the right to use the accumulated bonuses when purchasing fuel and other products at the Station.

2.5. Bonus account: the account on the card, to which bonus points are credited, which the Participant has the right to use when purchasing fuel or other products from the Station: 1 point = 1 AMD.

2.6. Personal account: The Participant's interface, which allows him to perform relevant operations on the Card: monitor the balance of the Bonus account, view the history of its replenishment/debit transactions, edit personal data, fill in his contact information, and perform other operations.

3. General conditions for participation in the program

3.1. Within the framework of the Program, the Company undertakes to provide bonus points to those Participants who, when purchasing fuel or other goods, will present an active Card at the Station, for purchases made within the bonus account, except for alcohol, cigarettes and liquefied gas.

3.2. The amount of points earned is determined based on the amount of the bonus return set for the Participant's respective level within the Program.

3.3. Points accumulation/withdrawal rate: 1 bonus point = 1 AMD of the Republic of Armenia. Exceptions may include cases of marketing and/or advertising campaigns organized by the Company.

3.4. The amount of bonus points and/or the terms of their provision set by the Company may be changed at any time. The changes shall enter into force upon publication on the Company's Website/Application, unless a different effective date is additionally determined upon their publication.

3.5. The Participant has the right to refuse to receive bonus points due to failure to present the Card at the Station.

3.6. The Participant can check the balance of his/her Bonus Account by logging into his/her Personal Account on the Company’s Website/Application.

3.7. The Card is intended for the Participant’s personal use for refueling his own vehicles or purchasing other goods at the Company’s Stations, and the Participant has no right to transfer/sell the Card to third parties. At the same time, the Company is not obliged to check whether the person presenting the Card and the Participant are the same person or not.

3.8. The Card is not accepted for payment and/or replenishment/debiting of the bonus balance:

  • if it has serious mechanical damage,
  • is blocked.

4. Card activation order

4.1. To activate the Card, the Participant must complete the Application and accept this Agreement presented on the Website/Application. At the same time, the Participant bears full responsibility for the accuracy of the information specified in the Application.

4.2. All fields of the Application marked with an asterisk (*) are mandatory.

4.3. By completing the Application, the Participant expresses his/her consent to participate in the Program and confirms his/her familiarity with the terms of the Agreement and all amendments and supplements made to it from time to time.

4.4. The Card is activated by the Participant at the time of registration on the Website/Application by attaching the Participant’s personal data to the Card in the Company’s database.

4.5. Before the Card is activated, bonus points are not provided for the purchase of fuel or other products.

5. Procedure for calculating and using bonus points

5.1. To collect bonus points, the Participant must present the Card to the Station cashier before making a purchase. Bonus points are credited to the Card exclusively when paying for fuel or other products with cash or a credit card. The amount of bonuses depends on the total accumulated amount of purchases. At the time of publication of the Agreement, bonuses are awarded depending on the level of the Loyalty Program of the corresponding Participant, as follows:

5.2. To use the balance in the Bonus Account, the Participant must present the Card and inform the cashier about the desire to use bonus points to pay for the purchase.

5.3. When making a purchase with bonus points, new bonus points are not awarded.

5.4. When making purchases by one Participant, bonus points can be used only from one Card.

5.5. Bonus points are available from the moment they are awarded.

5.6. Bonus points cannot be exchanged for cash.

5.7. Bonus points provided to the Participant cannot be sold or assigned to another person.

5.8. Bonus points are valid and can be used indefinitely.

5.9. Bonus points are not awarded for certain promotional and/or discounted products that do not participate in the Program (alcohol, cigarettes, natural gas, etc.).

5.10. The Company reserves the right to establish special conditions for the use of bonus points accumulated during marketing initiatives/programs/promotions, including the period of their use. In case of failure to use such points by the Participant within the specified period, they are canceled.

6. Procedure for blocking cards and restoring the Card balance

6.1. In case of loss/theft of the Card, the Participant must block it in one of the following ways:

  • The Participant may call the Company’s office (at the phone number specified in the website/ Application) with a request to block his/her Card, providing his/her identifier and PIN code, or submit a written application to block the Card by e-mail or at the Company’s office. At the same time, the Participant must not disclose his/her PIN code to third parties. Otherwise, the Company shall not be liable.
  • The Participant may independently carry out the Card blocking procedure by logging into the Personal Account on the Company’s website/Application.

6.2. At the request of the Participant, the lost/stolen Card is blocked, and the balance of the Bonus account is transferred to the new one. If the data specified in the identification document (passport) during registration does not match the data specified in the Application Form, the Card is not restored.

6.3. In case of replacement of the Participant's Card due to damage, demagnetization of the magnetic layer, damage to the chip, loss/theft of the Card, the balance of the Bonus account is transferred to the new Card.

6.4. In case of loss of the Card, the Participant may obtain a new Card in accordance with the procedure specified in the Agreement.

7. Liability of Parties

7.1. The Company and the Participant are responsible in accordance with the current legislation of the Republic of Armenia and the terms of the Agreement.

7.2. The Participant is responsible for the completeness and accuracy of the information specified in the Application. Thus, the Participant is fully responsible for providing incorrect information and entering the PIN code incorrectly, which entails the Company's inability to properly fulfill its obligations.

7.3. The Participant is fully responsible for the consequences that may arise as a result of the loss of the Card.

7.4. The Parties are exempted from fulfilling their obligations under the Agreement if they prove that the failure to fulfill the obligations is due to force majeure circumstances, that is, extraordinary and uncontrollable circumstances under the given conditions (fire, earthquake, mudslide and other natural disasters, epidemics, military operations, plant shutdown - for repairs or due to an accident, publication of acts by state bodies that do not allow the Parties to fulfill their obligations under this Offer), etc.

7.5. The Company is not responsible for any temporary delay in accruing/writing off discount points in case of technical malfunctions of the equipment and/or software failures.

7.6. The Company is not responsible for the Card if it is lost through the fault of the Participant or stolen by third parties and if the Buyer has not blocked it or blocked them untimely.

7.7. The Participant has the right to terminate his/her participation in the Program or cancel the Card at any time by submitting a written notice of termination to the Company.

7.8. The Company has the right to terminate or suspend the participation of any Participant in the Program without notice in the following cases:

  • The Participant does not comply with the terms of the Agreement,
  • there are sufficient grounds to assume that fraud is being committed using the Card.

8. Dispute Resolution

8.1. All disagreements and disputes that may arise from or in connection with the Agreement shall be resolved by the Company and the Participant through out-of-court negotiations. If such settlement of disputes is impossible, they shall be subject to transfer to the court of the Company’s location in accordance with the legislation of the Republic of Armenia.

8.2 In case of any questions regarding the Program, the Participants shall contact the Company by the telephone numbers specified on the Company’s website/Application.

9. Other terms

9.1. The Agreement shall come into force from the moment of its publication on the Company’s Website/Application and shall remain in force until terminated by the Company by posting a relevant notice on the Company’s Website/Application or by notifying the Participant through any other communication link.

9.2. The Company, at its sole discretion, has the right to make changes and/or amendments to the Agreement at any time. Information about these changes will be posted on the Company’s Website/Application. The Participant’s continued use of the Card after the changes to this Offer shall be deemed as the Participant’s consent to the changes made.

9.3. The Company reserves the right to terminate the Program at any time by notifying the Participants thirty (30) business days in advance. From the date of such notification, only bonus points may be used, but their accrual shall no longer be carried out.

9.4. The Participant agrees to receive promotional information messages from the Company within the framework of the Program. Promotional messages mean updated information, information messages about the latest news, new offers, special offers, as well as information about news and offers from the Company's partners via SMS and e-mail.
